So I'm minding my own business, cruising at 7 mph over the speed limit on I-80 in PA, somewhere in the Williamsport area, when I come across a trooper sitting in the median. I think nothing of it as I am not the fastest one on the road. After I pass, he pulls out and catches up to a group of truckers that I am cruising with. I move over to the right as he is gaining fast as I figure he is going someplace. He pulls in behind me... I'm like "WTF?!?!?!"

So I put on my signal to pull over, he hits the lights and I pull over as he obviously wants to talk to me about something. He walks up, and introduces himself (which I thought was nice). He then asks me why did I pull over. I tell him that he pulled out, came up to my car, then pulled in behind me, so I pulled over. He said, "oh, ok." He then asked me how fast I was going. I said about 72 (7 over), and he says that is exactly what he clocked me at. I have the most perplexed look on my face at this point. SO why is he here? ...... He then says that he pulled me over because my tint was too dark. I say "huh?" He said that he could not see me in my car and asked for my reg and license. As I am pulling them out, he sees a sheriff's business card as that is Sonya's father. He looks at the card and hands it back to me and heads back to his cruiser.

A few minutes later, he comes back and wrote me up for illegal tint @$103. He says that he does not have to test it with a meter. (HUH?) He also said that he COULD have written me up for a couple other things (oh yeah, like what?) SO if it looks illegal, it is illegal?!?!? Here is the kicker, I have Florida plates, where my tint is LEGAL. I think my ticket is not valid as my vehicle is legal in my home state. So every vehicle has to be legal in every state, not just where you live? :confused: If this were the case, all state's laws would be the same, no?

Any lawyer types out there?

Wow what a (insert foul language word here). Sorry Keith. Seems quite normal to me though. They prey on out of state people like you. I am not a lwyer, but yes its true. Your car must be legal in the state you are in at the time, not just your state rules. They love finding fault in tint, loud exhaust, and no front licence plate. Have a great trip, regardless of the haters.

Bottom line: Illegal tint in his jurisdiction is illegal regardless of the home state. I do not beleive the statement that he doesn't have to test it, but what do I know :o There is such a thing as officer' descretion. Maybe you just looked guilty :p

Keith - Sounds like my PA experience when I was moving and driving my tinted windowed 1987 Taurus in 1988 to the NYC area. I got stopped in PA and ticketed for speeding when I was not speeding because of the tint, and then stopped three times in NJ all about the window tint. As soon as I got to Jersey City, I had to pull it off the tint.

It could have been worse, try driving across PA and NJ with an Arkansas license plate and tinted windows....

was just looking to see what the law says in CA and stumbled across this link at a company site with shops in other states on interpretation of laws goverening tinting in PA. Looks like there is more left to interpretation in PA than some places. In CA like many places, you need to allow 70% transmision which isnt a very dark tint. I have a number of friends who have obviously darker tint and havnt had any problems, but.. they dont use carpool lanes anymore because if an officer has any trouble seeing who is in the vehicle you are asking to be stopped.

Yes and no. Yes the tint might have been illegal in Pen but legal in Florida, but Pen cannot always trump the state laws of other states.

I'm no lawyer, but technicalities always kill the courts. I have been to court on a speeding ticket where I was clocked by radar, and I beat the ticket in court, just payed court fees 45$ as opposed to over 200$ for the ticket and points on my license.

If you do decide to challange it, here are some tips from my experience. You will have to show up in court in Penn, can you do that if you are from Florida? If yes, then call the court and tell them you cannot apprear on the scheduled date, ask for as much of a future date as possible. Ask for a maximum extension on the court date. 30 days is norm, sometimes 60. Tell them your work or family issues will not allow you to appear on the orignal date.

Get the tint measured in Florida, then if possible, see if it is or is not over what Pen allows. Mention that the officer did not think he needed to use the "meter" to measure. That's like saying I estimate you were going at least 100 mph in a 50 zone, but I didn't use anything to mesure it. Very subjective.

20% of tickets written to out of staters get dropped because the policeman figure that you won't show up from Fla or whever you are from and he forgets the court date, especially if it's 2-3 months out. He or she basically think's it's bucks in the bag and a stat for them. The judge calls you and you stand in the docket, the judge calls the officer, usually twice. Officer no show means ticket thrown out in most states. Check with Penn to make sure.

Subpoena all possible equipment maintenance records as well as the ticketing officers training record. Many tickets are thrown out becaue the maintenance records are incomplete, or the unit has a history of problems, or the officer never went to the training course and it's not in any record. have documentation that the measuring device used in Fla was properly calibrated.

Show up to the court, have as much of the documentation as possible. You have already impresed them just by being there! When in court, speak clearly and respectfully, but also from a position of strength. Many Judges size you up while you are presenting your case. All you have to do is get the judge to think that there may be some isues with the case, the officers judgement, etc. You are innocent until proven guilty, and if you appear to be a no-nonsense, law abiding citizen it can make a big difference in the outcome.

OK last gasp from me. As example, Virginia is a two plate state, West Virginia a rear plate state, and D.C. is a 2 plate requirement. Virginia respects the laws of WV and does not write tickets even though they legally could. it would not good for relations. A lot of folks live in WV and work in DC for the feds. The DC police were writing tickets to WV cars because they only had one plate. WV'ers started parking in Virginia and taking public trans in to DC. End result was DC lost a lot of ticket revenue and what hurt them the most, less WV cars in the parking garages ment less dollars in the DC economy. DC had to back off.

Bottom line though is this:

103$ may not be worth the effort since it's not amoving violation and should carry no points or record.

You just need to have residency in FL.

Unlike a moving violation I think all Pa could do was issue a bench warrant that would be effective for Pa only ( I think ).

No, but the next time he gets stopped in PA he would be hauled to the hoosegow and his Accord would be towed.

Fatal mistake #1- NEVER tell them how fast you were going! Now he's got your admission to speeding.....just say you were'nt sure how fast you were going. He probably felt he was giving you a break by not writing you a speeding ticket that carries "points" with it, by giving you a non-moving violation instead.
As for the tinted windows; I don't know about PA, but in Jersey as long as you are not driving a NJ registered vehicle, we cannot enforce that. The ticket should be a loser, if you were to contest it. He's probably counting on the fact that you won't waste time to show up in Court.
I would have no problem with what the Trooper did, if he would have wrote you a "legit" ticket as a downgrade from speeding. It really burns me though when I see other cops do what he did. For 7 m.p.h. over the limit you would have just gotten a warning from me, if I would have even bothered pulling you over for that. Just my 2-cents worth... :rolleyes:

The sad thing is I've actually had a DUBLIN, OH cop say this to me... (I was witness to an accident, thankfully, not my own) - he called my truck a girly truck and said I needed to be driving something more manly like an F-150.

Don't-cha wish you could whip out a retort like: "Nah, I like my truck. I don't need to compensate for anything...." I think if I'd had done that, I would have found out exactly what a cavity search feels like. :eek:

I think that Kieth's ticket is a sign of things to come. A lot of folks have decided to take the pedal off of the metal. The locals are going to have to keep up the revenue somehow. I see the number of tint, broken equipment, and loud stereo tickets going up significantly.

PS. I'm all for the loud stereo tickets. There is nothing I hate more than to pull up to a light next to some kid who is listening to some loud crap that has enough bass to wake up my son in the back seat. Loud bass gives me a wee touch of the road rage. :eek:

I just saw Keith on Monday (Woodchuck transfer) and he's really, really disgusted with his Accord (long story but it does appear to be somewhat of a lemon) and this tint ticket just might be the straw that broke the camel's back! I did catch him gazing lustfully at my RL, so I got out of there quickly before his desires overcame his friendship! :eek:

As regards this tint issue, from what I've read online it appears that you're liable for the laws in the state in which you're currently driving, regardless of what the laws are in your state of residence. Know that this is a big problem with some of our friends up in VT (which allows NO tinting on the front side windows) who winter in FL and have their windows tinted down there.

Nope, I drove to Danbury to deliver it! Don't know if you can buy it in CT or not since I rarely go there (usually just driving through on my way to Boston or the Cape - and never to shop) but I offered to pick up a case for him since I was sort of "at the source" and was restocking my own larder as well.

Nah, I would've replied "Nah, I like driving a vehicle made in America and will be reliable past five years," or - in a feminine tone - "oh, sweetie, why thank you! I've always liked a man in uniform."

As for the ticket it makes me a very leary to go out of state as I drive a practically de-badged CR-V with "Arizona" tint meaning the windows are a bit darker then other places allow. I don't believe there should be such discrepancies allowed between states JUST because they are driving in the state. Yes, you should know the laws of the road but I don't think a vehicle with out-of-state plates should be pulled over for a non-moving violation UNLESS it is a severe safety hazard to either an officer or the passenger. From an officer's perspective, yes, a high-level of tint shouldn't be allowed and if I was a police officer I'd pull over a vehicle (test the tint) and if appropriate issue a ticket.

Waaaiiit a minute here. Is that picture from a HONDA meet or a "Ridgeline" meet? If so, then why is there an ACCORD AND an Element? What's going on there?

We aren't sure about that Accord guy... :)

My truck was made in Canada - as are most all Ridgelines right now. But, soon all Ridgelines will be coming off the line in Alabama (Wohoo - next International meet? Alabama?)

Keith is an alright guy!! Just does not know which Honda he prefers!!:) He has had a Civic, RL, and Accord within the past year. After this past weekend could an "E" be next? :rolleyes: Wow!! Lincoln, AL in 2009, just a few miles down the road!!:)

my 2 cents, i talked to a friend of mine who is a police officer the law here in mass. is that they can not give you a ticket for tints if you have out of state plates where it is legal there :)

See attached photo taken by Chris. Apparently while he was taking a photo of his accessory mirror turn signal indicators, Keith passed by in the inside lane with his window partially down.:rolleyes: View the contrast!! No jury would ever convict him with this photo as evidence!;)

You all crack me up. For those with real advice/info, it is greatly appreciated.

I had MANY people ask me about my tint ordeal and if I had been reading the thread all weekend.... even a couple of the Honda Engineers! :D (yes, they read all sorts of things on the ROC)

As for a future Ridge, I can definitely see it, especially after my "ride" at the TRC :eek: :eek: ... and a secret hint I got about future colors ;)

To Mike aka SpartanML - As we were chatting b-4 I left... Losing an hour to eastern time I got to the airforce base around 2-3 o'clock.... as requested Keith got alot of .... at the meet! :D

Too, some Officer find it insulting to 'sport' a Business card, badge or other from a different Sheriff's, Police, or Trooper's area. They feel you are 'using' it to skirt the law. **WHICH, you clearly weren't doing!!** :o

I would contact a lawyer in that area that offers free 30 minute consults(use google) and either fax or mail him a copy of your ticket and let them direct you further.

I called the phone number provided on my ticket today. I stated that I felt my ticket was unjust and explained my story (well, I made some of it up) (Fl vehicle, passing through PA and that my car is legal in FL as my sheriff friend had the tint installed and is a stickler for the law, blah, blah) and the lady told me to call back tomorrow after she talked to the judge. So another day to find out my fate as I'm certainly not driving 3.5 hrs to the court and 3.5 hrs back, not for ~$100 and no points.
That'd be better than KIWI.That's what we hear, though the Ridgeline owners didn't have a clue on the Element owner's laughs.

I'm terribly sorry, I wasn't implying you had displayed it. I was just commenting on how I've been yelled at for assuming I could get out of a ticket by flashing an old boyfriends shield. :o

Overall, the Elements had more issues getting there than the Ridges. Sitting in traffic behind the tractor trailer crash and another Element hitting the deer. I'll take my issue over the others.

A friend of mine in college had a very nice badge that read "USDA Federal Breast Inspector" with a cool leather flip case & everything. This was back in the hippie-dip days & I think it worked fairly well in barroom settings :p
