eBayers!! Read the feedback. Please....

I have had an issue with a ebay seller since a week before the super bowl.
I won the bid on a Palumalu jersey for Drew to wear to our super bowl party. The description read "New". It also read that it only had numbers on the back which was no big deal to me. I received the jersey in time for the super bowl and when Drew went to put it on it had white "paint" in the yellow letters and some of the number were "painted " white in some areas. To me, this is not new so I contacted the seller right away and they said send a picture. I took a picture and emailed it out on Monday after the super bowl. I heard back from them and they claimed that I bid on a "used" jersey as described. So I thought I goofed so I went back to the description and it read 'New" so I emailed the description to them. They proceeded to tell me that the "real" reason I had a problem was the fact that it did not have a number on the front. That never even entered my mind and I read that to begin with so that wasn't the issue. So we went back and forth for a few weeks. Finally, after offering no resolution I warned them that I was going to make a dispute claim with PayPal. They claimed they already did but they really hadn't. I followed the proper procedure to file a claim as much as I hated to do it. I would have settled for a new jersey as I was promised or even a partial refund but they refused to correspond with me past the claim warning.
PayPal did their thing and notified us both by email that the dispute was in progress. The seller had 10 days to answer the claim or forfeit the total amount I paid, back to me. THEY NEVER RESPONDED. So I was awarded my money by default and was not instructed to return the jersey. I went to my ebay account today and say that they gave me negative feedback. For their feedback I simply listed that anyone who wished the reason for my negative feedback could email me and I left it at that. I returned with another feedback explaining more and they wrote me a letter tonight telling me that I was turned into the FBI.
Are they KIDDING ME!!
That's got to be the biggest most obvious ignorant individual I have ever heard of. I have all the emails we sent back and forth and in them they say it was new and then they say it was used and then new again but I didn't like that it didn't have a number on the front.
I went back and read there feedback and it appears they have done this before.
What makes some people tick?

This is their most recent email to me tonight.


The bottom line in this transaction is that you defrauded me, and this situation is not over. I sold several of the same exact jerseys to other buyers without issue. I know why you pulled this with me, and it has nothing to do with anything being used. You did not read the description of the item. I put clearly that the item was blank in the front, and you failed to read the item's description. I have filed an internet fraud report with The FBI and you will have to deal with them. You have the item and the money, and I will not let this one go. I will save your email and forward it to them. Remember, you brought this on yourself.

Random Question: Is your buyer account registered under your personal or the buisness?

You misunderstood? ok fine we make mistakes - but they failed to act, their loss, they had a change to change it and they missed it. Now they are going to try to 'zing' you anyway they can.


Here is some notes from the IC3's fraud section btw....

Sellers acting as authorized dealers or factory representatives in countries where there would be no such dealers should be avoided.
Buyers who ask for the purchase to be shipped using a certain method to avoid customs or taxes inside another country should be avoided.
Be suspect of any credit card purchases where the address of the card holder does not match the shipping address. Always receive the card holder's authorization before shipping any products.
If you believe you may have fallen victim to this type of scam and wish to report it, please file a complaint with us.

In addition, visit eBay and PayPal for additional security alerts and fraud prevention tips.
On the flip side, whats with the paint on the shirt??

I don't know what the supposed value of that jersey is, but there is no way that the FBI would investigate anything. That's like saying that the FBI is going to investigate a case of shop lifting. Does the jersey have a logo on it? If so, is the Ebay seller licensed to sell that logo'd product, or is it a knock off? Maybe the FBI should investigate him. I'd Email back that you are anxiously awaiting your visit from the FBI.

Yeah the FBI has a whole team just for fraudulent Ebayers.LOL Thats enuff to make any bad day turn good. Youre more patient than me.I give about 1 week to make good.I would give them negative feedback on thier selling practice. I wouldnt worry so much what they wrote about you because unless you have several negatives people dont really care. They posted a neg. about your buying practice. Whats important is your selling practice.Am I going to get ripped off by this seller.Thats what I look at.

I believe this person is correct The NFL would probably frown greatly on someone selling an NFL product that is only partially personalized. I know when we were looking for a place to personalize our NHL jersey, they cannot do NFL jersies because of licensing issues.

I don't think you have anything to worry about. The FBI would consider this ridiculous in the grand scheme of things.

Stupid people, ugh. I think they were just scamming and are pissed they got caught.

Best thing you can do RidgeLady is to let ALL your ROC friends know about this eBay user... I'm sure we'd all be more than happy to not do business with them. Don't lose sleep over it. There is always one bad egg in every bunch...

Did I ever tell you about the creep who purchased a new pair of women's sneakers from my wife on eBay? Ya, he wanted her to email him pictures of her wearing them... I'll leave it at that. I will say had I lived closer to him on the West coast, I would have delivered the sneakers to him on the end of my foot...

eBay is Latin for "Creeps and Theifs are among us."

Here's what I think you should do. First it appears you got your money back and the jersey has been returned to the seller. The only remaining issue is the negative feedback left by the seller at eBay.

Contact the seller. Explain that you would like to put this issue behind you, but the negative feedback won't allow you to do so. Explain that you took several pictures of the jersey and know that it was not NFL Officially Licensed. Tell him you called the NFL Licensing Information Line (212) 450-2000 and they want the pictures and his personal information. Tell him that you would prefer that he remove the feedback within 48 hours and just end the issue. Otherwise you would feel obligated to cooperate with the NFL.

He can then initiate a Mutual Feedback Withdrawal at eBay:

Once he starts it you will receive a message asking if you approve. If so the feedback that both of you left on this item will be removed from your record.
