Don’t know about NY but in MD as long as the readiness monitors are complete and there are no DTCs, it will pass.

Would VCM activate in Park/Neutral? Is the vehicle driven with a pipe sniffer?

VCM does not operate in three-cylinder mode in park/neutral.
